Welcome to simplevenetianplaster.com (the “Site”). The Site is owned and operated by Simple Venetian Plaster (“Simple Venetian Plaster,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Site and any content, features, or services made available through it.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

If you are using the Site on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms, and “you” refers to both you and that entity.

The Site and its content are provided for general informational and educational purposes only. Nothing on the Site constitutes legal, financial, architectural, construction, or professional advice. You should consult appropriate professionals before making decisions related to your property or project.

2) Changes to these Terms

We reserve the right to update or modify these Terms at any time. Any changes will be effective upon posting to the Site unless otherwise stated. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

3) Privacy

Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using the Site, you consent to our data practices as described in the Privacy Policy.

4) Eligibility

• Interfere with or disrupt the Site’s operation or security

• Introduce malware, viruses, or other harmful code

• Use automated means (including bots or scrapers) to access the Site without prior written consent, except as permitted by law

• Collect or harvest information from the Site in a way that violates our Privacy Policy or applicable law.

• Misrepresent your identity or affiliation

• Use the Site to transmit spam or unsolicited promotional content

We reserve the right to restrict or terminate access to the Site for any violation of these Terms.

6) Accuracy, availability, and site changes

We strive to keep Site content accurate and up to date, but we make no guarantees regarding completeness, accuracy, or reliability. Content may change without notice.

7) Estimates, quotes, and project information

Any information provided on the Site about pricing, timelines, services, materials, or process is general and may vary by project.

Any quote, estimate, proposal, or timeline we provide (whether through the Site, email, phone, or otherwise) is non-binding unless and until both parties sign a written agreement (a “Project Agreement”).

Unless otherwise stated in a Project Agreement, final pricing may depend on site conditions, material selection, surface preparation requirements, access, scheduling, and other factors.

Photos and descriptions on the Site are examples and do not guarantee identical results, as plaster finishes are handcrafted and may vary.

8) Scheduling, site conditions, and homeowner responsibilities (if you hire us)

If you engage us for services, you may be responsible for providing safe and reasonable access to the job site and ensuring conditions that allow work to proceed, such as:

• Clear access to work areas.

• Reasonable climate control where needed for material performance.

• A safe working environment.

• Timely decisions and approvals.

Additional requirements, change orders, rescheduling terms, deposits, payment schedules, cancellation terms, and warranties will be defined in your Project Agreement. If there is a conflict between these Terms and a Project Agreement, the Project Agreement controls for that project.

9) Payments, deposits, and refunds (Site-related)

If the Site allows you to pay a deposit, consultation fee, or other amount online (if applicable), you agree that:

• Payments are processed through a third-party payment provider.

• You will provide accurate billing information.

• Any refunds (if available) are governed by the posted refund policy or your Project Agreement.

If the Site does not currently support payments, this section is included for future use and does not create an obligation to accept payments online.

10) Intellectual property and content ownership

Except as otherwise stated, the Site and its original content, including text, layout, branding elements, logos, graphics, and design (collectively, “Site Content”), are owned by or licensed to Simple Venetian Plaster and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Site Content for personal, non-commercial purposes only.

You may not copy, reproduce, distribute, modify, publish, sell, or exploit any Site Content without prior written permission, except as permitted by law.

Certain images displayed on the Site are AI-generated and are subject to the AI-Generated Imagery Disclosure below.

11) Photography, galleries, and visual representation

The Site may display photographs, videos, or visual renderings of interiors, finishes, or materials.

Unless explicitly identified as completed projects by Simple Venetian Plaster:

• Images are for illustrative purposes and represent a range of lighting, surfaces, and conditions.

• Color and finish appearance may vary based on lighting, substrate, camera settings, and display settings.

• Visuals do not guarantee identical results

Portfolio or project gallery pages, where applicable, are clearly designated. If you are a client and have questions about use of your project images, refer to your Project Agreement or contact us at info@simplevenetianplaster.com.

12) AI-Generated Imagery Disclosure

Some images displayed on this Site are artificially generated using generative AI tools, including Google Gemini (“AI-Generated Images”).

These AI-Generated Images are used solely for aesthetic, illustrative, and inspirational purposes, including:

• Creating a cohesive visual identity and site aesthetic

• Providing general visual representations of finish styles and textures

• Offering conceptual inspiration related to the specialty finishes offered by Simple Venetian Plaster

AI-Generated Images are not presented as photographs of completed projects, are not included in portfolio or project gallery pages, and do not represent actual work performed by Simple Venetian Plaster, unless expressly stated.

Simple Venetian Plaster does not claim ownership, copyright, or exclusive rights to AI-Generated Images. These images are shared in good faith in accordance with the usage rights of the AI platform used to generate them.

The AI-Generated Images on this Site were created using Gemini without the use of reference images or third-party visual inputs. To the best of our knowledge, the images were generated independently and are not intended to replicate identifiable copyrighted works.

If you believe that any image displayed on the Site infringes upon your rights or was generated using your proprietary content, please contact us at info@simplevenetianplaster.com. Upon receipt of a valid concern, we will promptly review and, where appropriate, remove the image.

To the maximum extent permitted by law, Simple Venetian Plaster is not responsible for the training data, internal processes, or outputs of third-party AI platforms.

13) User submissions and inquiries

If you submit information through contact forms, email, or other Site features (“Submissions”), you represent that the information is accurate and lawful.

You retain ownership of your Submissions, but you grant Simple Venetian Plaster a non-exclusive, royalty-free license to use them as necessary to respond to inquiries, provide services, operate the business, and comply with legal obligations.

14) Testimonials and reviews

The Site may include testimonials, reviews, or statements about experiences with our services. These reflect individual experiences and are not guarantees of specific outcomes. Results may vary.

If testimonials are edited, it is only for clarity or length, unless otherwise noted.

15) Third-party links and services

The Site may include links to third-party websites or services (for example, social platforms, embedded maps, scheduling tools, analytics, or payment processors). We do not control and are not responsible for third-party sites or services, their content, or their privacy practices.

17) Limitation of liability

To the maximum extent permitted by law, Simple Venetian Plaster will not be liable for indirect, incidental, consequential, or punitive damages arising out of your use of the Site.

Our total liability for any claim related to the Site or these Terms will not exceed the greater of one hundred U.S. dollars (US $100) or the amount paid by you through the Site in the twelve months preceding the claim.

18) Indemnification

You agree to indemnify and hold harmless Simple Venetian Plaster and its owners, employees, contractors, and affiliates from any claims arising out of your use of the Site or violation of these Terms.

19) Governing law and jurisdiction

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved exclusively in the state or federal courts located in Los Angeles, CA.

20) Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
